Terms of Use
Last updated: 24 September 2026
About These Terms
These Terms of Use ("Terms") govern your access to and use of the PowerUp platform, website (www.powerupglobal.io), and mobile application (together, the "Service").
The Service is provided by:
PowerUp Global SL, Calle Joan Verdeguer 116, 46024, Valencia, Spain (primary entity) and PowerUp Global Ltd, 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom
Together referred to as "PowerUp", "we", "us", or "our."
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Eligibility and Account Registration
1.1 You must be at least 18 years old to use the Service.
1.2 Access to the Service is provided to users authorised by an organisation — such as an employer, gym, sports club, association, coach, or other group — that has entered into a valid licence agreement with PowerUp ("Organisation").
1.3 You may create an account using an email address, or by email using single sign-on (SSO) via Google or Apple.
1.4 You are responsible for keeping the email address and any single sign-on account you use to access the Service secure. Since access to PowerUp is granted via one-time verification codes or SSO, the security of your PowerUp account depends on the security of those accounts. You are responsible for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at privacy@powerupglobal.io.
2. Organisation Licences
2.1 Where access to the Service is provided under a licence purchased by an Organisation, that Organisation is responsible for ensuring that users it authorises comply with these Terms.
2.2 PowerUp reserves the right to suspend or terminate any user account where the Organisation's licence is suspended, expired, or terminated.
2.3 The Organisation does not have access to your individual data. Any insights provided to the Organisation are aggregated and anonymised in accordance with our Privacy Policy. This does not apply where you have expressly authorised an individual coach or consultant to view your results under clause 3.8; that access is based on your own consent and is separate from the aggregated, anonymised insights provided to Organisations.
3. The Service
3.1 PowerUp provides a platform for psychometric assessment and personalised performance and well-being development at the individual, group, and organisational level.
3.2 The Service generates a personalised 12-week development cycle and Personal Development Activity based on your psychometric profile. This process is automated. You have the right to request a human review of your plan — see our Privacy Policy for details.
3.3 Data collected from individual users is used to provide personalised recommendations and, in aggregated and anonymised form only, to generate insights for Organisations, subject to minimum anonymity thresholds set out in our Privacy Policy.
3.4 The Service is not a medical device and does not provide medical advice. Any health-related data, analytics, or recommendations are for informational and personal development purposes only and are not intended to diagnose, treat, cure, or prevent any medical condition. This applies equally to any health and fitness data imported from your device or a connected health platform, and to any insights, explanations, or correlations generated from it. We do not verify the accuracy, completeness, or reliability of data provided by third-party health platforms or your device, and such data and any insights derived from it must not be relied upon for medical purposes. Always consult a qualified health professional regarding any health-related decisions.
3.5 The PowerUp AI Coach provides personalised explanations of your results using automated processing carried out by a third-party AI provider acting as our data processor. AI Coach content is for information and personal development only and may not always be accurate or complete; it does not constitute medical, psychological, or professional advice. Details of how this processing works and the provider involved are set out in our Privacy Policy.
3.6 Where available, the Service allows you to connect a health platform on your mobile device — Apple Health (HealthKit) on iOS, or Google Fit / Health Connect on Android — so that your health and fitness data can be displayed alongside your PowerUp results and used to generate personalised explanations. Connecting a health platform is optional, requires your separate explicit consent, and can be disconnected at any time through your device settings or your PowerUp account settings. Connected health data is not used to calculate your PowerUp scores. Further details are set out in our Privacy Policy and Health & Well-being consent.
3.7 PowerUp reserves the right to modify, update, or discontinue features of the Service at any time. We will provide reasonable notice of material changes where possible.
3.8 Where a coach or consultant holds a PowerUp coaching licence, they may invite you, using your email address, to share your individual profiling results and progress with them. The coach is given no access to your data unless and until you expressly approve the request. If you approve, the coach can view your individual profiling results and progress through a secure coaching portal. This access covers your profiling results and progress only; it does not include your connected health and fitness data or your AI Coach conversation history. Sharing your results with a coach is optional, requires your separate explicit consent, and can be withdrawn at any time in your account settings. Further details, including the basis on which the coach handles your data, are set out in our Privacy Policy.
4. Data Protection and Privacy
4.1 PowerUp processes your personal data in accordance with GDPR, UK GDPR, and applicable data protection law. Full details of how we collect, use, store, and protect your data — including your rights — are set out in our Privacy Policy at www.powerupglobal.io/privacy-policy. Please read it carefully.
4.2 Your agreement to these Terms does not constitute consent to the processing of your personal data. Consent to data processing, where required — including for psychometric profiling and for any connection of your health and fitness data and for any sharing of your results with a coach or consultant — is obtained separately during onboarding or at the point the relevant feature is enabled, in accordance with our Privacy Policy.
4.3 PowerUp may use anonymised and aggregated data derived from use of the Service to develop, improve, and operate its algorithms, analytics, and artificial intelligence systems. This processing is carried out in anonymised or aggregated form only and in accordance with our Privacy Policy. PowerUp does not make solely automated decisions that produce legal or similarly significant effects on individuals without providing the right to human review.

5.1 The Service uses cookies and similar technologies. Essential cookies are required for the Service to function. Non-essential cookies such as analytics and preference cookies require your prior consent, which is obtained through our cookie consent banner when you first visit the Service.
5.2 You can manage your cookie preferences at any time through the cookie settings in the footer of our website. Further details are set out in our Privacy Policy.
6. Intellectual Property
6.1 The Service, including all software, algorithms, content, text, graphics, data, and trade marks, is owned by or licensed to PowerUp and is protected by applicable intellectual property laws.
6.2 You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal or authorised organisational purposes in accordance with these Terms.
6.3 You may not copy, modify, distribute, sell, sublicense, reverse engineer, decompile, or otherwise exploit any part of the Service without our prior written consent.
6.4 Nothing in these Terms transfers any intellectual property rights to you.
7. Acceptable Use
You must not:
(a) use the Service for any unlawful, fraudulent, or unauthorised purpose; (b) share access to your account or allow any other person to access the Service using your identity; (c) attempt to gain unauthorised access to any part of the Service or its underlying systems; (d) upload, transmit, or introduce any virus, malware, or harmful code; (e) use the Service to harass, defame, discriminate against, or harm any person; (f) attempt to reverse engineer, decompile, or extract the source code of any part of the Service; (g) deliberately provide false, misleading, or manipulated responses in the psychometric assessment with the intent to distort results; (h) use data or insights obtained through the Service to profile, monitor, or evaluate individuals outside the permitted purposes set out in these Terms and our Privacy Policy; (i) infringe the intellectual property rights of PowerUp or any third party in connection with your use of the Service (j) attempt to manipulate, jailbreak, or otherwise circumvent the intended behaviour of the AI Coach or any other AI feature of the Service; (k) use the AI Coach to generate content that is harmful, abusive, discriminatory, or unlawful; (l) use the AI Coach as a substitute for professional medical, psychological, legal, or financial advice, or make clinical or health decisions based solely on its responses.
PowerUp reserves the right to suspend or terminate access where any of the above is suspected or confirmed.
8. Third-Party Services
8.1 The Service integrates with certain third-party services, including: Google and Apple for single sign-on authentication; Microsoft Azure and Azure Databricks for hosting, storage, and analytics; Microsoft Azure Application Insights for performance monitoring and diagnostics; Customer.io for email communications and user engagement; OpenAI for the generation of personalised explanations through the PowerUp AI Coach; and, where you choose to connect them, Apple Health (HealthKit) and Google Fit / Health Connect for the optional import of your health and fitness data. Additional integrations may become available over time and will be reflected in our Privacy Policy.
8.2 Any third-party integrations are optional and subject to you granting the relevant permissions. PowerUp is not responsible for the availability, accuracy, security, or content of third-party services. Use of third-party services is subject to those providers’ own terms and privacy policies.
8.3 PowerUp is not liable for any loss or damage arising from the acts, omissions, unavailability, or failure of any third-party service provider except where such loss arises directly from PowerUp’s failure to exercise reasonable care in selecting or instructing that provider.
9. Service Availability
9.1 PowerUp aims to provide a reliable and available Service but does not guarantee uninterrupted access.
9.2 We may suspend or restrict access to the Service temporarily for maintenance, security, or operational reasons. We will endeavour to give reasonable advance notice of planned maintenance where possible. Where we need to withdraw access permanently — for example where we discontinue the Service entirely or are required to do so by law — we will give you at least 30 days’ notice where it is within our power to do so and will ensure you can access and export your personal data before access ends. In cases involving serious breach of these Terms or legal obligation, access may be withdrawn immediately without prior notice.
9.3 PowerUp is not liable for any loss or inconvenience caused by unavailability of the Service, except where this is caused by our negligence or wilful default.
10. Limitation of Liability
10.1 Nothing in these Terms excludes or limits PowerUp’s liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
10.2 Subject to clause 10.1, PowerUp shall not be liable for any indirect, incidental, special, punitive, or consequential loss, including but not limited to loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of or inability to use the Service.
10.3 PowerUp’s total aggregate liability to you shall not exceed the total licence fees paid by your Organisation to PowerUp in the twelve months preceding the claim.
10.4 PowerUp does not exclude or limit any rights you may have under applicable consumer protection law, including under Spanish Royal Legislative Decree 1/2007 (General Law for the Defence of Consumers and Users) or the UK Consumer Rights Act 2015.
11. Termination
11.1 You may close your account at any time via your account settings at app.powerupglobal.io/settings or by contacting privacy@powerupglobal.io. We will process your request within 30 days and handle your personal data in accordance with our Privacy Policy.
11.2 PowerUp may suspend or terminate your access to the Service immediately if:
(a) you or your Organisation's licence is terminated or expires; (b) you cease to be authorised by your Organisation; (c) you breach these Terms; or (d) we are required to do so by law or a competent authority.
11.3 On termination, your licence to use the Service ceases immediately. PowerUp will handle your personal data following termination in accordance with our Privacy Policy.
12. Changes to These Terms
12.1 PowerUp may update these Terms from time to time. When we make material changes, we will notify you via the Service or by email at least 14 days before the changes take effect.
12.2 Your continued use of the Service after that notice period constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, you must stop using the Service and may close your account in accordance with clause 11.1.
13. General
13.1 Severability: If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
13.2 Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and PowerUp regarding your use of the Service and supersede any prior agreements or understandings.
13.3 Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
13.4 Force majeure: PowerUp shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, cyberattacks, or failure of third-party infrastructure.
13.5 Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. PowerUp may assign its rights and obligations under these Terms to an affiliate or successor entity without your consent, provided your rights under these Terms are not materially affected.
14. Governing Law and Jurisdiction

The courts of England and Wales shall have jurisdiction to resolve any dispute arising from these Terms or the Service, without prejudice to any mandatory rights you may have under applicable consumer protection law.
